Abstract

The interplay between rhetoric and law is as old as the subjects themselves. In classical antiquity, rhetorical writings as well as rhetorical training took court proceedings as a main point of departure. Today however, there is more to the field of rhetoric and law than teaching persuasive communication in the courts. The two subjects are combined in a variety of ways, and law and rhetoric is a multifaceted discipline. The paper maps and discusses different ways law and rhetoric are combined in a number of key texts in the field and offers a framework to understand the diversity of discipline. Three main perspectives are uncovered: 1) Law and rhetoric as a discipline of practical communication in court; 2) law and rhetoric as a methodological and didactical discipline, and 3) law and rhetoric as philosophical discussions of the legal system.
